目前我国执行过程中存在执行难、执行乱的现象。出现这些问题的最重要的原因就是执行权力过大,缺乏有效的外部监督。在我国当前的司法体制下,应当确立完善对民事执行活动的检察监督体制,包括确立检察监督的原则,检察监督的管辖以及检察监督的程序模式。 At present, there is a problem that enforcement is difficult and execution is chaotic in our country’s implementation process. The most important reason for these problems is that they have too much executive power and lack effective external supervision. Under the current judicial system in our country, a system of procuratorial supervision over civil enforcement activities should be established, including establishing the principle of procuratorial supervision, the jurisdiction of procuratorial supervision and the procedural model of procuratorial supervision.
