目前中国国际商事仲裁模式是单一的机构仲裁,其存在程序性、仲裁员专业对口和效率等方面局限,而且难以适应新商事经济发展以及造成国内外公民权利义务不对等,不过鉴于我国仲裁员队伍管理体制、社会公信力系统工程尚不完善,不适合全面引进随意仲裁制,因此可以采取折衷的方式在发展较为成熟、程序灵活性需求旺盛的海事领域引进随意仲裁制度,通过建立“禁止反言”、“用尽救济”以及“期限”等有效的法院监督体制,在克服其缺陷的前提下将其最优应用到中国国际海事仲裁案件中,作为试点工程,开启中国国际商事仲裁“双轨并存”模式。
