依据南京国民政府于1948年制定的《公务人员任用法》、1985年在台湾地区制订的《教育人员任用条例》、1995年颁布的《教师法》及这些法律文本的修正条款为原始资料,探讨不同历史背景之下,政府处理“不适任教师”的做法及特点。研究发现,台湾地区70年来处理“不适任教师”法制化过程分为道德规范、行政规范和法律规范等三个时期。法律规范时期分为初期阶段、确立阶段及逐步完善阶段。其中的主导力量是政治与社会变迁带动下,学生受教育权与教师工作权两股势力之间的折冲协商。有关“不适任教师”的条文立法及修正显示了一段教师与学生权力关系演变的历史面貌。
According to the “Civil Service Appointment Law” promulgated by the Nanjing National Government in 1948, the “Regulations on the Appointment of Education Employees” promulgated in Taiwan in 1985, the Teachers Act promulgated in 1995, and the amended clauses of these legal texts, Under different historical backgrounds, the government deals with the practice and characteristics of “disqualifying teachers”. The study found that Taiwan’s 70 years of handling “ill-suited teachers ” legal process is divided into three periods of moral norms, administrative norms and legal norms. The period of legal norms is divided into initial stage, stage of establishment and gradual improvement stage. Among them, the dominant force is the reciprocal negotiation between the two forces, the right to education and the right to work for teachers, driven by political and social changes. Legislation and amendments to the articles on “incompetent teachers” show the history of the evolution of the relationship between teachers and students.
