公民的基本权利神圣不可侵犯。如果人人都享有绝对的自由,则人人均无自由可言。因而,在承认公民所享有的基本权利的同时,必然包含着对基本权利的限制。本文指出,对基本权利的限制毕竟导致基本权利的不完整,因而也有必要对基本权利的限制加以规范,否则限制基本权利,极容易异化为公权力侵犯公民基本权利的籍口。正因为如此,对公民基本权利的限制,自身也必须接受从根本大法的高度进行限制。
The basic rights of citizens are inviolable. If everyone enjoys absolute freedom, everyone has no freedom at all. Therefore, while acknowledging the basic rights enjoyed by citizens, it is bound to contain the restrictions on basic rights. This paper points out that the restriction of basic rights leads to the incompleteness of basic rights, and therefore it is also necessary to regulate the restrictions of basic rights. Otherwise, the restriction of basic rights can easily be turned into a pretext for public rights infringement on the basic rights of citizens. Because of this, the restrictions on the basic rights of citizens must also themselves be subject to the limitation of fundamental law.
