案情回放路某于2005年5月15日到某公司(外资)处工作,担任公司营运部经理职务,2006年3月任公司营销总监,但双方一直未签订劳动合同。双方口头约定路某的工资为基本工资加提成。2006年3月份以前路某的月基本工资为1700元,2006年3月份以后路某的月基本工资为2000元。2006年2月1日起至2006年8月,路某除在2006年春节休假5日外,从未休过节假日。2006年8月9日,公司通知路某解除与他的劳动关系,并且未支付路某8月份工资、提成。
