案情简介2006年春节前夕,人们都急切返乡过年。来粤务工的汤先生在广东某火车站购买了一张返回西安的火车票,票价310元,开车时间1月25日21:22分。汤先生因家中临时有急事不能按计划安排行程,于当天21:30分到火车站购票处退票,票务人员以“车已开走”为由,当场拒绝退票。之后,王先生对该火车票重新进行了签证,并以“三天内到达有效”为由再次向火车站提出了退票要求,然而,改签过的车票再次遭到拒绝退票。在万般无奈的情况下,汤先生委托律师,以某火车站的上级法人单位某铁路企业为被告,向法院提起诉讼,要求该铁路企业返还票款310元,并承担其他相关费用共2000多元。
