随着全球治理的纵深发展,国际金融与劳工、环境、健康、教育等问题表现出更加紧密的联系,这意味着公众应该与传统的治理主体一起参与国际金融立法。然而,实践中公众参与路径不能满足公众的利益诉求和基本的权利维护。因此,必须顺应全球金融治理的发展趋势,全方位、多角度地为公众参与立法提供制度保障:实现公众参与立法的稳定性;确保公众参与立法的有序性;提高公众问责的可行性。我国应该借鉴发达国家经验,一方面“培育”高素质的公众团体,提高它们的国际影响力,另一方面降低非政府组织和其他公众团体准入门槛,构建完备的准入后管理体系,从而提升国际金融立法话语权。
With the continuous development of global governance, the international financial and labor, environment, health, education and other issues show more intimate contact, which means that the public should participate in international financial legislation along with the traditional governing body. However, in practice, the path of public participation can not satisfy public interest demands and basic rights maintenance. Therefore, it is necessary to conform to the development trend of global financial governance and provide institutional guarantee for public participation in legislation from all angles and angles: to ensure the stability of public participation in legislation; to ensure the public participation in the orderliness of legislation; and to increase the feasibility of public accountability. Our country should learn from the experience of developed countries on the one hand to “nurture” high-quality public bodies and enhance their international influence; on the other hand, it should lower barriers to entry for non-governmental organizations and other public bodies and establish a comprehensive post-entry management system , So as to enhance the right of speech in international financial legislation.
