我国建立在“担保物权绝对优先”“普通债权平等受偿”规则基础上的破产劳动债权保障机制有较大缺陷,不仅劳动债权的权利定性有待商榷,《企业破产法》确立的劳动债权普通优先权地位也因关键配套程序的缺失而难以落实。要破解劳动债权保障不力难题,必须对现行机制进行反思,并在“正当程序”理念的指引下,从赋予破产企业工会或其他职工代表组织程序主体资格、明确相关主体对破产劳动债权人的法定通知义务、赋予破产劳动债权人对相关决议案的一票否决权以及一定限度的担保撤销权等细节入手,完善我国的破产劳动债权保障机制。
