迁徙自由是现代社会公民的一项基本权利,当今世界大多数国家的宪法和国际公约都对迁徙自由权做出了规定。我国现行宪法未对迁徙自由作出规定,但是近年来,随着市场经济的建立和发展,人们对权利的要求日益迫切,要求迁徙自由入宪的呼声越来越高,恢复迁徙自由已势在必行。本文从理论上剖析了对迁徙自由进行宪法保护的理论基础,以期为迁徙自由立法提供理论支撑。
Freedom of movement is a basic right of citizens in modern society. The constitutional rights and international conventions of most countries in the world today stipulate the right of freedom of movement. However, in recent years, with the establishment and development of market economy, people’s demands for rights have become more and more urgent.
