我们应当加快信访立法步伐,信访立法的目标应当是落实公民的宪法权利,统一协调信访,使争议能够协调、有序、分层次解决。信访立法应当坚持以下基本原则:以科学的制度设置来减少越级上访,以刚性的制度规定来落实信访权利,以宽广的视野来重构信访制度,以改革的精神来配置争议解决权力,以宽容的态度来保障信访秩序。在未来的信访法中我们应当确立人大统领、县为基础、行政监察专员等基本制度。
We should speed up the pace of petitioning legislation. The goal of petitioning legislation should be to implement the constitutional rights of citizens and to unify letters and visits so that disputes can be resolved in a coordinated, orderly and hierarchical manner. The legislation of petition should adhere to the following basic principles: to reduce petty petitions with a scientific system, to implement the right of petition with a rigid system and to reform the system of letters and visits with a broad perspective and to configure the power of dispute resolution in a spirit of reform so as to be tolerant Attitude to protect the petition order. In the future letters and visits law we should establish the basic system of people’s congress leadership, county-based, administrative inspectorate.
