“斯图加特21”是一项改造斯图加特火车总站的建设工程,工程建设受到当地民众强烈抗议,以对其财政预算举行全民表决而暂告结束。受其影响,《德国行政程序法》增加了提早的公众参与条款;为了配合能源转型,《德国高压电网扩建加速法》设计了多次公众参与的模式,希望借此提高民众接受度并加快工程建设。公众参与并不能实现民主正当性,却是法治的必然要求。行政机关对建设工程享有最终批准决定权,面对规划“民主化”呼声,公众参与必须限定在政治和法律框架之内。
