一般侵权责任的构成要件有四个,新闻报道侵害名誉权的行为有其特殊性,使得新闻报道侵害名誉权的侵权责任的构成要件具有不同于一般侵权责任的特点。此类案件的举证责任不能简单用“谁主张、谁举证”的原则来处理。
There are four constitutional elements of general tort liability, and the news report infringement of reputation right has its own particularity, making the news report that the elements of tort liability infringing the reputation right have the characteristics different from the general tort liability. The burden of proof in such cases can not be dealt with simply by the principle of “who claims and who evidences”.
