征收与征用属于两种不同的制度,各有不同的概念内涵;财产权过度限制应给予补偿,且纳入征用制度为宜。公益征用包括三类:第一类指国家在平时暂时使用或占用公民、法人或其他组织的财产,为普通征用;第二类指国家在紧急状态下,临时征用或调用集体或公民财产的情况,为紧急征用;第三类主要指财产权过度限制,为管制征用。
