当前,农村干部利用职权犯罪的案件呈逐年上升趋势,主要表现为犯罪主体集中;犯罪手法较为简单,涉嫌罪名集中;窝案、串案比较突出;涉案金额逐年递增。究其原因:一是农村干部自身文化素质不高,法律意识淡薄;二是选举源头上存在瑕疵,村级组织建设薄弱;三是财务管理混乱,制度形同虚设;四是监督机制失灵,内外部监督乏力。对此,提出五项对策:一要规范“村官”选举,肃清源头;二要多措并举,努力提高“村官”队伍的整体素质;三要强化基层管理的规章制度建设,规范基层权力运行;四要完善村级财务监督机制;五要充分发挥检察机关的职能作用,加强惩治与预防农村职务犯罪的力度。
At present, the number of criminal cases of cadres using their positions is on an upward trend, which is mainly manifested as the concentration of criminals. The method of committing crimes is relatively simple and the charges are concentrated. The cases of litigation and collusion are more prominent and the amount of cases involved is increasing year by year. The reasons are as follows: First, rural cadres have low cultural awareness and weak legal awareness; second, there are flaws in the election sources and the construction of village-level organizations is weak; third, financial management is chaotic and the system is neglected; fourth, failure of supervision mechanisms and internal and external supervision Fatigue. In this regard, we put forward five countermeasures: first, we must standardize the election of “village officials” and eliminate the source; second, we should make every effort to increase the overall quality of the ranks of “village officials”; and third, we must strengthen the establishment of rules and systems for grassroots management , Standardize the operation of grassroots power; fourth, improve the village-level financial supervision mechanism; and (5) give full play to the procuratorial organs’ functions and strengthen the efforts to punish and prevent rural job-related crimes.
