文章闸述了代孕的产生和发展过程,立足于我国代孕面临的法律困境,借鉴国外关于代孕的立法实践,进而提出有关代孕行为合法化前的纠纷解决对策,以及代孕行为合法化后的立法建议,旨在通过法律的完善使得“代孕”早日走出尴尬的境地。
This article describes the generation and development of surrogacy. Based on the legal predicament faced by surrogacy in our country and drawing lessons from the foreign legislation on surrogacy, this paper puts forward the countermeasures of dispute resolution prior to the legalization of surrogacy and the legislative suggestions after the legalization of surrogacy , Designed to make the “surrogate” out of the awkward situation as soon as possible through the improvement of the law.
