为了回应依法治国方略的内在要求及其带来的挑战 ,法院改革目标应定位在 :构建为法官进行自主性判断提供保障的权威性司法体制 ;造就具有较高的司法理性水准的专业型法官队伍 ;形成尊重法官司法职业理性的法官中心型内部管理机制 ;建立对审判权进行合理的限制与约束的责任型审判权监督制约机制 ;探索合理配置诉讼资源和司法资源的市场型与福利型相结合的诉讼机制。在实现法院改革目标过程中 ,建构理性和进化理性同样不可或缺。
In order to respond to the inherent requirements of the strategy of governing the country according to law and the challenges it poses, the goal of the court reform should be: to establish an authoritative judicial system that guarantees judges’ autonomous judgment; to create a team of professional judges with a high standard of judicial justification ; Forming a judge-centered internal management mechanism that respects the judicial professionalism of judges; establishing a system of supervision and restriction of responsibility-based jurisdiction that rationally restricts and restricts judicial power; and exploring the combination of market-based and welfare-oriented rational allocation of litigation and judicial resources Litigation mechanism.
