第一条为了规范建设工程价款结算工作,促进缩短建设工期,合理、及时地供应建设资金,加速资金周转,根据国家有关结算的规定和建设工程管理的规定,制定本办法。第二条凡在建设银行开户的建设单位、建筑安装企业、城市建设综合开发公司、工程承包公司和其他单位,需要进行工程价款结算的,均按本办法的规定办理。其他银行办理建设工程价款结算,也应按本办法规定办理。第三条建设工程发包单位和承包单位应按照《建筑安装工程承包合同条例》的规定,根据批准的计划、设计文件和概(预)算或招标投标的中标标书内容签订工程承包合同,订明工程项目名称、工程造价、工程开工、竣工日期以及材料供应方式和工程价款结算等事项,明确双方权利、义务。
Article 1 These Measures are formulated in order to standardize settlement of construction projects, promote shortening of construction period, supply of construction funds in a reasonable and timely manner, and speed up the flow of funds, according to the provisions of the State on settlement and the construction project management. Article 2 All construction units, construction and installation enterprises, integrated urban construction and development companies, engineering contracting companies and other units that need to carry out settlement of construction price when they open an account with China Construction Bank shall go through the provisions of these Measures. Other banks for construction projects settlement price, should also be handled according to the provisions of this approach. Article 3 The contracting units and the contracting units of the construction projects shall sign the construction contract according to the approved plans, design documents and contents of the bid winning (pre) calculation or bidding and bidding, in accordance with the Regulations on Contracts for Contracting for Construction and Installation Works, stipulating Project name, project cost, start of construction, completion date and material supply and settlement of construction projects and other matters, clear the rights and obligations of both parties.
