《物权法》确立了平等保护、物权法定、公示公信的物权三原则,明确了农村土地承包经营权的物权性,并对行政权产生了相应的制约。平等保护原则要求国家、集体和个人在土地承包中地位平等,征收土地足额补偿,行政机关侵犯土地承包经营权应承担与私人侵权等同的法律责任;物权法定原则要求各级政府及其工作部门修改相应的法规、遵守行政法中的法律保留原则;公示公信原则要求行政登记主体按照《物权法》的规定,切实做好土地承包经营权证的发放工作和流转登记工作。
The Real Right Law establishes three principles of real right of equal protection, statutory property right and public letter of public accountability, clarifies the property right of rural land contracting and management right, and has corresponding restriction on executive power.
