中国拥有悠久的历史和文化,民间文学艺术长期扎根发展于中国,却未受到应有的保护,很多民间文学艺术面临灭绝。我国2010年的《著作权法》中规定民间文学艺术的著作权保护由国务院另行规定[1],迄今仍未公开颁布,在关键的法律依据上仍属空白。司法实践以及社会事实反映出对其保护的紧迫性,而其作品定性是现在的理论门槛。研究民间文学艺术的可作品性,是对民间文学艺术进行著作权保护的前提。
China has a long history and culture. Folk literature and art has long been rooted in China but has not been properly protected. Many folklore are facing extinction. China’s 2010 Copyright Law stipulates that the copyright protection of folklore shall be stipulated separately by the State Council [1] and has not yet been promulgated so far. It is still a blank on the key legal basis. Judicial practices and social facts reflect the urgency of their protection, and the qualitative characterization of their works is the theoretical threshold nowadays. Studying the workability of folk literature and art is the premise of copyright protection of folk literature and art.
