虽然由于刑事法律文献资料绝大多数都以记载国家正统的刑事立法与刑事司法为已任,而使作为在国家刑事诉讼体制之外存在的一种民间活动或司法过程中一种非法定方式的刑事和解,很难找到相应的系统充分的历史文献直接加以论证;同时,由于现代刑事法史学的研究对象通常也只限于国家刑事法律与正规刑事司法的演变发展,故而分散的、个体化、地方化、非法定常规化的被害人与犯罪人之间的刑事和解,也因难以进入研究者的视野或受到其关注而缺乏系统的引证资料。但是,借助于对中国社会长期制度变迁的考察并通过分析中国传统社会文化、法律文化所反映的社会现实,即可确认刑事和解在中国古代社会具有存在的合理性和必然性。

However, with the help of the investigation of the long-term institutional changes in Chinese society and the analysis of the social reality as reflected in the traditional Chinese culture and law and culture, we can confirm that the criminal reconciliation is justified and inevitable in ancient Chinese society.
