在我国经济的不断进步和发展及城市化进程不断加快的时代背景下,各种工业和城市污染问题也越来越突出。当前,超标排水、排气、排污、重金属污染等破坏生态环境的现象,给人们的正常生产生活带来了严重的影响。为了及时采取有效措施,打击环境犯罪,用法律途径惩治环境犯罪行为,促进我国社会生态环境质量水平的不断提高,进一步完善我国环境犯罪的刑罚迫在眉睫。因此,本文将在分析当前我国环境犯罪相关刑法存在问题的基础上,对完善环境犯罪刑法做进一步的研究,以为打击、惩治环境犯罪提供充足的法律依据。
Against the backdrop of the continuous economic progress and development of our country and the accelerating process of urbanization, various industrial and urban pollution problems have become increasingly prominent. At present, excessive discharge, exhaust, sewage, heavy metal pollution and other damage to the ecological environment have a serious impact on people’s normal production and living. In order to promptly take effective measures to combat environmental crimes, use legal channels to punish environmental crimes and promote the continuous improvement of the quality of our social and ecological environment, it is imminent to further improve the penalties for environmental crimes in our country. Therefore, based on the analysis of the current criminal law related to environmental crime in our country, this article will make further research on perfecting criminal law of environmental crime and provide sufficient legal basis for cracking down and punishing environmental crime.
