在社会转型时期,司法效果一直是社会各有关方面广泛关注的焦点。对于司法效果,无论是理论界还是司法实务界,大多从法律效果和社会效果有机统一角度来分析司法效果的,却很少对司法效果进行研究。并且由于人们在理解法律效果和社会效果时缺乏统一的标准,往往仁者见仁,智者见智。因此,如何选择一个新的角度来分析司法效果,对于实现最佳司法效果具有重要意义。本文从社会转型期的司法功能与司法效果、能动主义司法功能观与司法效果,及克制主义司法功能观与司法效果,还有最佳司法效果的实现:司法能动与克制的平衡几个部分进行说明,进一步阐释以社会转型期能动主义与克制主义的司法功能观为视角的司法效果论。
