国际经济学理论定义中的“倾销”一词通常指产品以低于国内市场价格在国外销售,或以低于生产成本的价格出售给进口国家。目前倾销理论与实务涉及的大部分内容都属于制造业产品,在一定程度上造成倾销理论在实践领域的不完善。美墨两国冬季蔬菜倾销与反倾销之争引起我们对倾销认定过程中的经济学与法律分析深层矛盾及其实践缺陷的理论思考;美国对墨西哥铃状椒倾销案的调查判断过程为我国应对国外产品倾销、出口产品直面国外倾销调查提供了新的实践思路。
The term “dumping” in the definition of international economics generally means that the product is sold abroad to a foreign country at a price lower than the domestic market or at a price below the cost of production. At present, most of the contents involved in dumping theory and practice belong to manufacturing products, which, to a certain extent, causes the imperfection of dumping theory in the field of practice. The dispute over vegetable dumping and anti-dumping in the United States and Mexico in the two countries aroused our theoretical thinking on the deep contradictions in economic and legal analysis of dumping determination and its practical defects. The United States’ investigation of the dumping case of Mexican bell pepper Dumping of products, export products facing dumping investigations abroad provides a new way of thinking.
