现行宪法有些部分已经滞后于经济社会发展形势,修改宪法已势在必行。究竟如何修改,专家学者们众说纷纭。鉴于中国渐进式改革的实际,宪法不可能一步到位。应当抓住宪法的精神实质,从规范公民权利入手。其一、宜将“尊重和保障人权”写入《宪法》。以往因为意识形态的影响,我们将人权问题视为西方的“陷阱”,但随着改革开放的进一步发展,中共十五大、十六大都肯定了“尊重和保障人权”的重要原则和价值观念,中共十六大报告指出:“要保证人民依法享有广泛的权利和自由,尊重和保护人权”。我国政府先后于1997年和1998年签署了《经济、社会、文化权利国际公约》和《公民权利和政治权利国
Some parts of the existing constitution have lagged behind the economic and social development. It is imperative to amend the constitution. How to modify, experts and scholars have different opinions. Given the reality of China’s gradual reform, it is impossible for the Constitution to be in place. We should seize the spiritual essence of the constitution and start from standardizing citizens’ rights. First, it is appropriate to include “respect and guarantee human rights” in the Constitution. In the past, because of the influence of ideology, we regarded the human rights issue as a “trap” in the West.
