建立健全紧急状态立法体系,不仅能防止政府在紧急状态时期滥用权力,而且能确保公民权利在非常时期不受随意侵害,它是一个国家紧急状态时期实行法治的基础。本文在分析我国紧急状态立法的现状及其存在问题的基础上,从构建完备的立法体系这一角度出发,提出完善我国紧急状态立法的具体措施和建议。
Establishing and perfecting the legislative system of emergency can not only prevent the government from abusing power during emergency, but also ensure that civil rights are not infringed arbitrarily in extraordinary times. It is the basis for the implementation of the rule of law in a state of emergency. Based on the analysis of the status quo and existing problems of the legislation on emergency in our country, this paper puts forward the concrete measures and suggestions on how to perfect our legislation on emergency from the perspective of building a complete legislative system.
