武警法赋予了武警采取一系列强制措施的职权。在理论上澄清武警强制措施的含义及其性质,对准确适用武警强制措施,规范武警部队的行为,有效完成维护国家安全和社会稳定的任务具有重要的意义。本文从武警法的立法精神和对相关规定出发,首先对武警强制措施的概念进行了界定,进而概括出主体的特定性、内容的法定性、程序上的不可诉性等特征,最后辨析了武警强制措施与其他法定强制措施的区别。
The Armed Police Law has given the Armed Police the power to take a series of coercive measures. To clarify theoretically the meaning and nature of the compulsory measures of the armed police, it is of great significance to accurately apply the compulsory measures of the armed police, standardize the behavior of the armed police forces, and effectively accomplish the tasks of safeguarding national security and social stability. Based on the legislative spirit of Armed Police Law and the related regulations, this article first defines the concept of armed police coercive measures, and then summarizes the characteristics of subjectivity, the legal nature of the content and the procedural implacability. Finally, Differences between coercive measures and other statutory coercive measures.
