西南边境民族地区边民、非边民非法出入境现象长期普遍存在,相关法治陷入困境,主要原因包括立法、执法及当地社会生活环境等方面的问题。应从出入境相关的正式制度、非正式制度的完善入手,探寻突破困境的相应对策。当生活逻辑与法律逻辑冲突时,不能简单的、绝对的以一种逻辑的正当性来否定另一种逻辑的正当性。解决国家边缘地带存在的特殊问题,是具有全国意义的重要问题。从导致困境的原因分析入手,突破法治困境,将是一个漫长的、循序渐进的过程。
The phenomenon of illegal immigration of border people and non-border citizens in the southwest frontier ethnic areas has long been widespread and the relevant laws go hand in hand with difficulties mainly due to issues such as legislation, law enforcement and the local social environment. We should start from the perfection of the formal system related to exit and entry and the improvement of the informal system to find out the corresponding countermeasures to break the dilemma. When the logic of life conflicts with the logic of law, we can not simply and absolutely reject the legitimacy of another by a logical justification. To solve the special problems existing in the fringes of the country is an important issue of national significance. Starting from the analysis of the causes leading to the dilemma and breaking through the dilemma of the rule of law, it will be a long and gradual process.
