当前企业之间的竞争十分激烈,尤其是国际间贸易的增多,企业面临更严峻的生存环境。在充满竞争风险的社会环境中,公司法也进行了不断的调整,公司法的功能和体系也在发展和变化。通过对现代公司法总则的研究,可以看出现代公司法总则更加注重风险防范,在公司法总则中加入了风险防范理念以及风险防范的具体措施,以此来降低企业发展中面临的危险。
The current competition among enterprises is very fierce, especially with the increase of international trade and enterprises facing more severe living environment. In the social environment full of competition risks, the company law has also been constantly adjusted, and the function and system of corporate law are also developing and changing. Through the study of the general rules of modern company law, we can see that the general rules of modern company law place more emphasis on risk prevention, and the risk prevention concept and the specific measures of risk prevention are added into the general rules of corporate law so as to reduce the risk to the development of the enterprise.
