随着人民监督员制度的全面铺开及实践,由试点之初对人民监督员制度的争论亦渐渐平息,说明社会对人民监督员制度存在的合法性、合理性已形成共识。如何更好的发挥人民监督员制度的作用,转而成为人们关注的焦点。人民监督员对“三类案件”的监督,由于程序清晰,刚性强,不确定因素少,实行起来比较顺利,已见明显成效。而对“五种情形”的监督,虽已陆续破题,但无论从广度还是深度上,与设立人民监督员制度的初衷都还有一定距离。因此,实现对“五种情形”监督的大的突破,已成为当前落实人民监督员制度亟待解决的问题。笔者尝试在现有规定框架内,围绕如何有效开展对“五种情形”的监督,进行以下探讨。
As the system of people’s supervisors has been fully implemented and practiced, the debate over the system of people’s supervisors from the beginning of the pilot project has gradually subsided. This shows that there is consensus in society on the legitimacy and rationality of the system of people’s supervisors. How to better play the role of the people’s supervisor system has become the focus of attention. Due to clear procedure, strong rigidity and few uncertainties, the supervisory supervision of the “three types of cases” by the people’s supervisors has been implemented smoothly and has seen remarkable results. However, the oversight over the “five situations” has been breaking the title one after another, but there is still a certain distance from the original intention of setting up a people’s supervisor system in terms of breadth and depth. Therefore, realizing the major breakthrough in the supervision of the “five situations” has become an issue to be urgently solved in the current implementation of the system of people’s supervisors. In the framework of the existing provisions, the author attempts to conduct the following discussion around how to effectively supervise the “five situations”.
