孙立丽与中国职工之家之间的计划生育纠纷案历时两年多,孙虽在劳动仲裁、民事一审和民事二审中屡遭败诉,但仍坚持申诉,她的理由是中国职工之家的行为违反了国家和北京市计划生育的法规和政策严重侵犯了她的人身权利和劳动权利。而作为另一方的中国职工之家则坚持认为,自己是依照本单位的计划生育规章对本单位工作人员作出的内部处罚,是合法、有效的。双方各持一辞。该案现正由最高人民检察院立案审查,决定是否予以抗诉。就这件纠纷案而言,涉及的法律问题主要集中在以下几点上,在此谨作简要地分析。
