宽严相济的刑事司法政策是我们党和国家的一项重要的刑事司法政策。宽严相济,区别对待,也是我国现阶段惩治与预防犯罪的基本的刑事政策。本文通过对宽严相济刑事政策的渊源、依据、界定、适用等的认识,指出实施宽严相济的刑事政策,是社会的一种进步,体现了罪刑法定原则和罪责刑相适应原则的精神,对于有效地打击犯罪,化解矛盾,维护社会稳定具有重要的意义。
