日本《独占禁止法》于二战后的1947年在美国占领军的监督下形成,制定之初的法律较多地体现美国法的色彩,在历经60多年的实践和几次有针对性的修改后,最终演变成具有日本特色的法律,成为日本政府调节市场经济、维护竞争秩序、实现资源有效配置的工具。该法为维护日本公正且自由竞争、激发经营者的创造性、推动经济繁荣等发挥了重要作用,也是日本经济取得巨大成功的经验之一。
Japan’s “Exclusive Ban Law” was formed under the supervision of the occupying forces of the United States in 1947 after the Second World War. The laws enacted at the beginning reflected more colors of the American law. After more than 60 years of practice and several targeted changes , Eventually evolved into a law with Japanese characteristics and became the instrument used by the Japanese government to regulate the market economy, maintain a competitive order and realize the efficient allocation of resources. The law has played an important role in safeguarding Japan’s fair and free competition, stimulating the creativity of its managers and promoting economic prosperity. It is also one of Japan’s hugely successful economic experiences.
