我国目前尚无一部全国性的公共图书馆法,虽然我国已颁布了6部地方性图书馆法规和8部地方性图书馆规章,但这些法规和规章均存在诸多问题。美国犹他州图书馆法内容全面、操作性强,值得我国在图书馆基本法立法过程中加以借鉴。通过从经费、管理体制、图书馆员职业资格认证、馆际合作、文献资源建设、用户服务、图书馆安全方面具体分析美国犹他州图书馆法的内容,对我国图书馆法的制定可得出以下有益启示:图书馆法应是一个完整的法律法规体系;图书馆法应具有可操作性;立法后应不断修订完善;图书馆法应对经费的来源和额度做出明确规定;建立图书馆员职业资格认证制度;建立公共图书馆理事会制度;加强对弱势群体的援助。
At present, there is no national public library law in our country. Although China has promulgated 6 local library regulations and 8 local library regulations, many problems exist in these laws and regulations. The Utah Library Act of the United States is comprehensive in content and highly operational, and it is worth our country’s reference in the legislative process of library basic law. Through the analysis of the contents of the Utah Library Law from the aspects of funding, management system, professional qualification of librarians, inter-collegiate cooperation, construction of literature resources, customer service, and library security, we can draw the conclusion of our country’s library law The following helpful enlightenment: Library Law should be a complete system of laws and regulations; library law should be operable; Legislation should be continuously revised and perfected; library law should be the source of funding and quotas to make clear that the establishment of librarians Vocational qualification certification system; the establishment of the public library council system; strengthen the assistance of vulnerable groups.
