作为刑事庭前准备程序的重要内容,庭前会议(Pretrial Conference,亦称“审前会议”)是由法官召集的为案件开庭审理做准备的会议。2012年修订的《中华人民共和国刑事诉讼法》(以下简称新刑诉法)第182条第2款首次规定了庭前会议程序,打破了我国刑事审判程序由起诉到审判的直接过渡,搭建起了中国特色庭前会议程序的框架。新刑诉法实施以来,各地就庭前会议程序进行了探索与实践,在收获预期效果的同时,也存在不可忽视的问题,亟须及时总结反思,实现制度完善。
As an important part of criminal court preparation procedure, a pretrial meeting (Pretrial Conference, also known as “pretrial meeting”) is a meeting convened by a judge to prepare for trial of a case. Paragraph 2 of Article 182 of the Criminal Procedure Law of the People’s Republic of China (hereinafter referred to as “the new Criminal Procedure Law”) revised in 2012 for the first time prescribes the procedure of pre-court meetings, breaking the direct transition from prosecution to trial in China’s criminal trial procedures and setting up The framework of pre-court proceedings with Chinese characteristics. Since the implementation of the new Criminal Procedure Law, various localities have explored and practiced the procedures of pre-trial meetings. At the same time of harvesting the expected results, there are also problems that can not be ignored. It is imperative to sum up the reflections in time to improve the system.
