《不战公约》、日本国民的厌战情绪、币原喜重郎的和平思想、麦克阿瑟的作用等影响日本宪法和平思想的历史因素构成了日本宪法第九条的思想背景。以此为基础,分析宪法制定过程中的以及宪法条文中的“废除战争”与“放弃战争”之间的关系,明确提出,废除战争是目标,日本为此目标而率先放弃战争,批判拥有和平宪法的日本实质上扩充军备的矛盾做法。最后,研究市民防卫论、建立世界政府的可行性、以及跨国民间合作网络的形成等问题,为废除战争提供了可靠的理论根据。
The historical factors that affect the constitutional peaceful thinking of Japan, such as the “War Without Convention”, the warlike emotions of Japanese nationals, the peaceful thought of Kihara Kiriharu and the role of MacArthur constitute the ideological background of Article IX of the Japanese Constitution. Based on this, the author analyzes the relationship between “abolishing war” and “giving up war” in the formulation of the constitution and in the constitutional provisions, and puts forward clearly that abolishing the war is the goal and Japan took the lead in giving up the war in that regard , Criticizing Japan’s virtually constitutional expansion of armaments as a contradiction. Finally, the study of civil defense theory, the feasibility of establishing a world government, and the formation of a cross-border cooperation network have provided a sound theoretical basis for the abolition of the war.
