当前我国已缔结了130个双边投资协定(BITs),其中有49个规定了国民待遇条款。尽管各个BITs中有关国民待遇的内涵、例外规定等具体措辞并不一致,但总体趋势还是朝着促进投资自由化的方向发展。现阶段衡量投资自由化的一个重要标准在于是否给予外资准入前的国民待遇,中国就这一问题,始终持保留态度。鉴于中国目前在国际投资法领域的双重身份,应秉持冷静谨慎的态度对待准入前国民待遇,并及时对已有BIT中的国民待遇条款加以改进和完善才能在对外缔约谈判中掌握主动权。
At present, China has concluded 130 BITs, of which 49 stipulate the terms of national treatment. Although the specific wordings such as the connotation and exceptions of the national treatment in each BITs are inconsistent, the overall trend is still toward promoting investment liberalization. An important criterion for measuring investment liberalization at this stage lies in whether or not to grant national treatment before foreign-funded accession. China always maintains a reservation on this issue. In view of China’s current dual status in the field of international investment law, China should take the calm and cautious attitude toward the pre-admission national treatment and timely improve and perfect the existing national treatment clause in the BIT in order to hold the initiative in the process of negotiation.
