经济全球化的发展促使跨国垄断进入到了一个全新的发展阶段,国际垄断势力对中国的影响将更为复杂,跨国并购、直接投资等经济活动将越来越多的影响中国经济的发展。反垄断法作为规制妨碍竞争的垄断行为、维护市场机制有效运作的法律,必然要对经济全球化背景下的跨国垄断新发展新变化做出必要的应对。只有认真分析经济全球化背景下跨国垄断的新趋势新变化,借鉴世界主要国家对于跨国垄断新发展的应对措施,才能更加深刻认识、改正我国《反垄断法》的不足,从而从容应对跨国垄断的挑战。
The development of economic globalization has led to the cross-border monopoly entered a new stage of development. The influence of international monopoly on China will be more complicated. Economic activities such as cross-border M & A and direct investment will increasingly affect the development of China’s economy. Antitrust law, as a monopoly for regulating the obstruction of competition and the law for safeguarding the effective operation of the market mechanism, must make the necessary response to the new developments and changes in the cross-border monopoly under the background of economic globalization. Only by carefully analyzing the new changes in the new trend of cross-border monopoly in the context of economic globalization and using the responses of the major world countries to the new development of cross-border monopolies can we deepen our understanding and correct our deficiencies in the “anti-monopoly law” so as to deal with the problem of cross-border monopoly challenge.
