随着现代法治社会的不断发展,刑事司法领域也越来越注重和谐司法的理念。本着以人为本的基本原则,和谐的刑事司法理念也正在和将要发挥更大的作用。因此,在这个趋势下,刑事调解也渐渐得到人们的重视。刑事调解不但对贯彻罪行法定原则有着积极的作用,而且对于减少诉讼成本,维护当事人的合法权益和促进刑事诉讼和谐理念的发展具有重要的作用。加大力度构建刑事诉讼调解程序,对促进我国刑事诉讼程序的完善和发展,推动刑事诉讼民主和谐地发展也具有深远影响。本文通过对当前我国刑事调解法律程序困境的分析,对刑事诉讼调解的价值探讨入手,从而提出相关建议,以期构建一个科学完备、正当有序、具有中国特色的基层法院刑事调解程序。
With the continuous development of modern law society, more and more attention is paid to the concept of harmonious administration of justice in the field of criminal justice. In line with the basic principle of putting people first, the idea of a harmonious criminal justice is being and will be playing a greater role. Therefore, under this trend, criminal mediation has gradually gained people’s attention. Not only does criminal mediation play a positive role in implementing the statutory principle of crime, but also plays an important role in reducing litigation costs, safeguarding the legitimate rights and interests of litigants and promoting the development of a harmonious conception of criminal procedure. Intensifying efforts to establish a procedure for the mediation of criminal proceedings will have far-reaching effects on the improvement and development of criminal proceedings in our country and the promotion of the democratic and harmonious development of criminal proceedings. Based on the analysis of the current dilemma of legal procedure of criminal mediation in our country, this article starts with the value of the mediation of criminal procedure, and puts forward relevant suggestions in order to establish a criminal mediation procedure of grass-roots court with complete science, proper order and Chinese characteristics.
