2001年12月22日,日本政府下令海上保安部队和自卫队出动舰艇和飞机,公然在公海上击沉一艘不明国籍的船只,导致15名船员全部死亡。这是日本战后56年来首次向外国船只开火攻击,并造成船沉人亡的严重后果。 事情发生后,日本当局声称,日本巡逻艇对不明国籍的可疑船只采取行动是“正当防卫”,有联合国海洋公约以及日本渔业法、海上保安法、刑法等有关法律为依据。但是,无论从联合国海洋法还是从日本相关法律来看,日本当局的所谓“正当防卫”论,是根本站不住脚的。
On December 22, 2001, the Japanese government ordered the Marine Security Forces and the Self-Defense Forces to dispatch ships and planes and publicly sunk a vessel of unknown nationality on the high seas, resulting in the death of all 15 crew members. This is the first serious consequence of Japan’s firing on foreign vessels in the 56 years since the war and the resulting death of the ship. After the incident, the Japanese authorities claimed that Japanese patrol boats acting on suspicious vessels of unknown nationality are “justifiable defenses” and are governed by the United Nations Convention on the Oceans and the Japanese Fisheries Law, the Maritime Security Law and the Criminal Law. However, no matter from the UN law of the sea or from the Japanese laws, the so-called “justifiable defense” theory of the Japanese authorities is simply untenable.
