我国现行劳动争议处理制度的核心是“一调一裁两审”。这种制度在应然性设计中,其仲裁部分是劳动争议解决过程中的核心,而诉讼与调解却充分具备辅助与补充等特质,三者之间相辅相成却更有层次也更加分明。本文从劳动争议的主要内容开始进行分析,明确当前现行劳动争议的定义与特点,探索我国现行劳动争议处理制度存在的缺陷,研究完善我国现行劳动争议处理制度缺陷的主要对策,从而增强调解、仲裁、诉讼这三大制度的功能,保证劳动争议处理达到预期效果。
