本文分析了中国航天技术进入国际市场后所产生的一系列法律问题。关于赔偿责任,根据中美协议,中国作为发射国把发射卫星的赔偿责任全部承担下来,但中国并非卫星制造国或经营国,因此在中英交换照会中明确规定中国仅对发射阶段承担赔偿责任,从而为今后中国发射外国卫星提供了一个先例。本文从法律角度对保障卫星技术安全,国际市场通行做法以及产品责任问题均作了介绍。中国同有关国家这成的协议将是确立有关国际规章的重要步骤。
This article analyzes a series of legal issues arising after China’s space technology entered the international market. With respect to liability, according to the Sino-U.S. agreement, China as a launching country took full responsibility for the compensation for transmitting satellites. However, China is not a satellite manufacturing or operating country. Therefore, in the Sino-British exchange note, China stipulates that China will only be liable for the launch phase. This will provide a precedent for China to launch foreign satellites in the future. From the legal point of view, this article introduced the issues of the protection of satellite technology safety, the international market practices, and product liability issues. The agreement between China and the relevant countries will be an important step in establishing relevant international regulations.
