行政公益诉讼现象越来越常见,在《中华人民共和国行政诉讼法》(以下简称《行政诉讼法》)以及《最高人民法院关于执行〈中华人民共和国行政诉讼法〉若干问题的解释》(以下简称《若干解释》)关于原告资格的规定较为模糊的情况下,大量行政公益诉讼被法院拒之门外,当事人的权利得不到救济,但也正因为其模糊性,使得这些条文具有一定灵活性与授权性。为此,我们应该对《行政诉讼法》以及《若干解释》中关于原告资格的规定重新解读并适当灵活适用,针对具体个案时采利益衡量的方法,即通过法官采用“法律发现”之方法将部分公益诉讼合法化,为当事人能够顺利进入行政诉讼程序提供法律依据。
