基于我国城乡分割的两种土地公有制,在我国现行法上形成了城乡分割的两套不同的建设用地使用权制度:一套是城市国有建设用地使用权制度;另一套是农村农民集体所有建设用地使用权制度。因此,在思考如何完善我国建设用地使用权制度时,必须分别予以讨论。
