坚持党的领导,坚持中国特色社会主义制度,贯彻中国特色社会主义法治理论是中国特色社会主义法治道路的核心要义。理解这一要义,应当重点把握好三个内核:首先,中国特色社会主义法治的本质是保障人民当家作主。法治超越人治、优干法制,法治的本质是民主,“人民是依法治国的主体和力量源泉”昭示了中国特色社会主义民主法治与西方民主法治的本质不同;其次,中国特色社会主义法治的核心是维护公平正义,实体公正与程序公正辩证统一于中国特色社会主义法治建设之中;最后,党的领导是全面推进依法治国的根本保证,只有在党的领导下依法治国,人民当家作主才能充分实现,国家和社会生活法治化才能有序推进。

Secondly, The core of which is to safeguard fairness and justice, substantive justice and procedural fair and dialectical unity in the construction of the socialist legal system with Chinese characteristics. Finally, the leadership of the party is the fundamental guarantee for promoting the rule of law in an all-round way. Only under the leadership of the party, The Lord can fully realize that the rule of law in the country and society can be promoted in an orderly manner.
