黄河水权制度的演进是我国西北干旱地区水权制度变迁的缩影。本文考察了建国后的黄河水权制度演进历程:公共水权基础上的非正式水权制度;非正式制度依然起主导作用,正式水权制度雏形显现;正式水权制度约束为主,出现可交易水权制度的萌芽。分析了不同阶段水权制度演进的诱因,水资源所有权、配水量权、用水顺序权、水行政管理权等的界定和变化以及在水权制度演进过程中正式制度与非正式水权制度的摩擦与作用,还对制度演进过程中的用水效率进行了探讨。最后对尚处于萌芽状态的黄河可交易水权制度的建立和西北干旱地区节水型社会的建设提供有益的启示。
The evolution of the water rights system in the Yellow River is a microcosm of the changes in the water rights system in the arid areas of northwestern China.
