随着我国经济的快速发展和城市化进程的不断加快,房屋拆迁是一个无法避免的问题,也是社会矛盾激化的重要原因之一。目前,我国房屋拆迁方面立法上存在缺陷,管理混乱,严重影响了我国社会秩序的稳定和和谐社会的构建。新出台的《物权法》加大了对公民私有财产权的保护力度,开启了房屋拆迁的新模式。本文主要从《物权法》视角下审视现今的城市房屋拆迁制度,指出我国原有房屋拆迁立法的缺陷,阐述《物权法》对拆迁模式的新规定,并分析新出台的《物权法》的实施对房屋拆迁制度的影响。
With the rapid economic development in our country and the accelerating process of urbanization, house demolition is an unavoidable problem and one of the important reasons for the intensification of social conflicts. At present, China’s housing demolition legislation defects, management chaos, seriously affected the stability of our social order and the construction of a harmonious society. The newly introduced “Property Law” has increased the protection of private property rights of citizens, opening a new mode of housing demolition. This article mainly examines the current urban house demolition system from the perspective of “Property Law”, points out the defects of our country’s existing house demolition legislation, expounds the new provisions of the “Property Law” on the demolition mode, and analyzes the implementation of the “Property Law” The impact of the system.
