2012年的《环境保护法修正案(草案)》就环境信息公开制度的设计已有重大突破,但仍存在制度定位不准确、法条编排思路混乱、结构不合理、法条繁简失调、相关制度未能集中规定等不足。《环境保护法》的总则应明文宣示公众参与为环境法的基本原则,并以此为前提和依据,确立环境信息公开制度的环境法基本法律制度地位,进而区分主体和行为的种类,分散地规定组成我国环境信息公开制度的要点,为日后下位法的立法细化奠定制度架构。此外,还须确保每类环境信息公开的违法行为均有对应的法律责任。
There have been major breakthroughs in the design of the environmental information disclosure system in the 2012 Amendment to the Environmental Protection Law (Draft), but there are still some problems such as inaccurate institutional positioning, confusion in the legal arrangements, irrational structure, complicated and irregular laws, System fails to focus on such provisions. The general provisions of the Environmental Protection Law should explicitly declare the public participation as the basic principle of environmental law. Based on this premise and the basis, we should establish the basic legal system of environmental law as an open system of environmental information and further distinguish the types of subjects and behaviors. Stipulate the key points that form the open system of environmental information in our country and lay the institutional framework for the legislative refinement of the lower law in the future. In addition, it is also necessary to ensure that each type of disclosure of environmental information has a corresponding legal liability.
