我国《物权法》第243条选取了一种不同于大陆法系经典立法例的模式,规定了善意占有人对于孳息不享有权利,但是纵观整个民事法律规范以及司法解释,却没有对以孳息这一基本法律概念的定义或者解释,在过往的学说对于收益用益等概念并没有科学区分,这在法律的适用上难免会造成争议,本文以《物权法》第243条为视角,并参考大陆法系经典民法典,比较研究了孳息、产物、使用利益等概念,区别对待收益与用益两组概念。对于我国应该如何给予孳息一准确定义做出了建议,避免法律适用的无序与争议。同时,对于孳息的解释和定义,也有利于我国民法总则部分的完整和科学,对今后即将出台的民法典起到帮助作用。
