本文紧紧围绕对公共权力制约这一主题,论述了在借鉴人类文明的优秀法治成果的基础上,从中国传统文化和现行政治体制出发,通过理顺执政党的领导权与人大的立法权、政府的行政管理权、审判机关的司法权的界限,以及突出宪法的崇高地位,强化人大职能,完善司法体制的方式,从公共权力内部之间的监督制约公共权力:同时通过发展市场经济,培育市民社会,加强大众传媒的舆论监督的方式,从外部依法制约公共权力的行使主体,防止其滥用,从而实现法治社会的途径。
