依法治国是一项长期的治国方略,党的十八届四中全会将依法治国提到了一个十分重要的战略高度。在大多数学者将其仅仅当作一种治国方略进行研究的时候,笔者发现了这个文化领域的独特视角。从法律的产生来看,它本就是文化的一种表现形式;从法律的性质而言,它是上层建筑的重要组成部分,也是文化发挥治理作用的一个重要组成;从依法治国目前所遇到的困境而言,更为根本的是要论一个“文化适应性”的问题。从承认依法治国与以德治国相结合的合理性前提出发,笔者从中国的法治传统入手,论证依法治国在中国有着一定的文化生存土壤,并在发现依法治国的文化困境之时提出在文化视域下依法治国的相关思考。
Ruling the country by law is a long-term strategy for running the country.
